Marketing opt-in and opt-out provision

When you register for Saga Carnival, you may opt-in to receive marketing information via email from Saga Carnival, the cruise line, promoters and/or venues. This information will include the latest news on events, promotions, contests and/or lucky draws.

If you change your mind at any time and wish to un-subscribe, you may easily do so via the un-subscription link found on each email.

Information Collection and Use

We collect and use your personal information to allow us to provide services and features to meet your needs and to customise and improve our services to make your experience more secure and convenient. We only collect personal information about you that we consider reasonably necessary for achieving these purposes.

If you choose to use our services, we may require you to provide contact and identity information and other personal information as indicated on the forms throughout the Site. Where possible, we will indicate which fields are mandatory and which fields are optional.

In general, we collect and use your personal information to facilitate our provision of the services requested by you. We will maintain a file about you and your use of our services. We will collect, use and retain the information in your file and such other information that we may obtain from time to time in connection with your current and past activities on the Site, for as long as the purpose for which the information is collected continues or where otherwise necessary for legal purposes or the purposes of our normal business operations. Thereafter, we will destroy or delete the information, or remove the means by which the information can be associated with you. The above mentioned purposes may include but are not limited to: resolving disputes; troubleshooting problems; helping promote secure trading; collecting fees owed to us; conducting surveys, obtaining customer feedback and measuring consumer interest in our products and services; communicating with you (including on behalf of the cruise line, promoters or venues from whom you have a ticket); informing you about online and offline offers, products, services and updates; customising and optimising your experience on the Site; detecting and protecting us against error, fraud and other criminal activity; and such other purposes as may be notified to you before or at the time of collection or use of the information. In particular, where you opt to receive marketing information from Saga Carnival, we will use your email address to send you our e-newsletters and/or electronic direct marketing materials.

We may also look across multiple users to identify problems or resolve disputes and in particular, we may examine your personal information to identify users using multiple user-IDs or aliases. We may also compare and review your personal information for errors, omissions and/or accuracy.

Under some circumstances, we may require certain financial information from you. We use your financial information (including credit card information) only to verify the accuracy of your name, address and other information, to detect any fraud or other criminal activity and to bill you for your use of our services.

We automatically track certain information based upon your behaviour on the Site. We use this information to do internal research on our users’ demographics, interests and behaviour to better understand, protect and serve our users in general and you in particular. This information may include the URL that you just came from (whether this URL is on the Site or not), which URL you next access (whether this URL is on the Site or not), your computer browser information and your IP address.

We use data collection devices such as “cookies” on certain pages of the Site to promote trust and security, help analyse our web page flow and measure promotional effectiveness. “Cookies” are small files placed on your hard drive that assist us in providing our services. We may offer features that are only available through the use of a “cookie”. We also use cookies to reduce the number of times you need to enter your password. Cookies can also help us provide to you information that is targeted to your interests. Most cookies are “session cookies”, meaning that they are automatically deleted from your hard drive at the end of a session. You are always free to decline our cookies (if your browser permits you to do so), although in that case you may not be able to use certain features on the Site and you may be required to enter your password more frequently during a session on the Site.

Sharing with and Disclosure to Third Parties

As a matter of policy, your personal information will not be shared or disclosed to third parties (whether for their marketing purposes or otherwise) without your consent. However, we reserve the right to disclose your personal information to our third party service providers (including any third party service provider which hosts or manages data from this Site; credit, debit and charge card companies, banks and other entities processing payment instructions given by you through this Site; lawyers; auditors; and any other agents or subcontractors acting on our behalf), government or regulatory authorities and/or the cruise line, promoters or venues from whom you have purchased a ticket, to the extent required in the normal course and scope of our business in the provision of our services and where required or permitted by applicable law, statute, stock exchange regulation or by-law, regulatory or governmental order or court order. Your information will not be transferred to third parties outside of the United States of America and the Commonwealth of the Bahamas except in accordance with the requirements prescribed under the applicable Personal Data Protection laws of the Commonwealth of the Bahamas.

On occasion, we may collect, use and/or disclose your personal information as a data intermediary on behalf of another organisation which may include the cruise line, venue operator, event promoter or ticketing company of the show, event or attraction for which you have purchased tickets (“Transacting Party”). You hereby agree that we may disclose your data to a Transacting Party and that the Transacting Party may use your data for purposes of administering the Event and all other purposes set out in this Privacy Policy and where specifically agreed in writing by you.

Security

Your privacy is important to us. We put in place reasonable security arrangements (which shall at least be equivalent to industry standard practices) to protect your privacy and personal information, in such manner and to such extent as we deem reasonably appropriate to prevent unauthorised access, collection, use, disclosure, copying, modification, disposal or similar risks. However, there is no such thing as “perfect security” and we do not guarantee in any way and you should not expect that your personal information or private communications will always remain private and/or safe from any abuse or misuse by third parties.

Your information is stored on a cloud server. We use such procedural and technical safeguards as we deem reasonably necessary to protect your privacy and to protect your personal information against loss, theft and unauthorised access, collection, use, disclosure, copying, modification or disposal. Such safeguards include but are not limited to the use of encryption, firewalls and Secure Socket Layer technology. We will also employ the appropriate security techniques to reasonably protect data against loss, theft and unauthorised access, collection, use, disclosure, copying, modification or disposal by users inside and outside Saga Carnival.

Saga Carnival protects the personal information it collects in a secure database with important information being encrypted and the database servers are hosted in a protected data centre. Saga Carnival employees are required, as a condition of their employment, to treat personal information held by Saga Carnival as confidential and to maintain the confidentiality of that personal information.

As “perfect security” does not exist, Saga Carnival does not represent or warrant that there will not be and hereby disclaims any responsibility or liability directly or indirectly arising out of or in connection with, any loss, theft, or unauthorised access, collection, use, disclosure, copying, modification, disposal or similar actions with regard to any information held or maintained by us.

Changes to the Privacy Policy

Saga Carnival reserves the right to amend its prevailing Privacy Policy at any time and will place any such amendments on this Site.

Governing Law

This Privacy Policy is governed by and shall be construed in accordance with the laws of the Commonwealth of the Bahamas, without giving effect to any principles of conflicts of law. By accessing this Site and providing information requested, you agree to submit jurisdiction of the courts of the Commonwealth of the Bahamas.

Returns & Refund Policy

Refunds

Due to the unique nature of our event, All Deposits, All Monthly Payments and payments for All Costume Upgrades and Event Tickets are Non-Refundable and are Non-Transferable.

Guest Cancellation Policy

Any and all cabin reservation cancellations, VIP Package purchases, pre-party purchases, Saga Carnival offered shore excursions, and the additional taxes/fees/gratuities are non-refundable for any amount or any reason, and cancellation forfeits all payments.

There are NO exceptions to our cancellation policy. We strongly recommend the purchase of travel insurance.

All cancellation requests must be submitted in writing by using our Cancellation Request Form.

No-Shows

There will be no refunds given for those who do not board the ship on time, unused tickets, or after the Cruise has occurred. If a flight or other delay for any reason prevents you from joining the cruise by the boarding time on the departure date, you will be considered a no-show, and we cannot provide a full or partial refund or credit toward a future cruise. Please note that your decision not to travel due to advisories or fear of travel will constitute a cancellation by you. No refund or credit will be given for any unused features or early departures for any reason.

Please note the cancellation provisions of these Terms apply to all events hosted by regardless of any representations made by the Cruise Line, whether in its passenger contract terms or elsewhere. All rights granted to passengers in the ticket contract relating to the payment or refund of cruise fare and to cancellations by passengers shall not be operative.

Travel Insurance

Given the unique nature of our events and our cancellation policies, Saga Carnival strongly recommends the purchase of Travel Insurance from Travel Guard to protect you against financial loss due to non-refundable costs and fees due to unexpected cancellations and travel emergencies.

Although travel insurance is offered to guests during the reservation process, all travel insurance policy sales and payments are made directly with Travel Guard and are non-refundable. You will need to contact Travel Guard directly with any insurance questions. 

If your trip costs change or increase after purchase (due to a cabin category change, for example), you will need to contact Travel Guard to update your policy coverage. Failure to do so may result in loss of coverage.

Terms & Conditions

The following Terms and Conditions (“Terms”) for Saga Carnival (inclusive of the “Cruise”, “Events” or “Carnival Parade” (whether purchased together as a package or individually), as well as the terms and conditions described in the cruise line’s ticket contract provided by the cruise line (“ticket contract”), contain important contractual terms, conditions, and limitations on your rights, and constitute a legally binding contract between you and Saga Carnival (collectively referred to herein as “Saga Carnival” or “Saga”), as well as the cruise line and their respective officers, directors, employees, agents and contractors (collectively referred to herein as the “Released Parties”), with respect to the Events hosted by Saga Carnival. All guests must read, agree to and accept these Terms BEFORE booking any experience with Saga Carnival and retain them for future reference.

All references to “Shipmates”, “Guest” or “Masquerader” shall have the same meaning as “Passenger” for the purposes of these Terms and shall include each person listed on a cruise ticket and each person, other than Saga Carnival and the cruise line personnel, and performing artists and artist personnel, who embarks on the cruise or attends any Saga Carnival hosted event, whether or not listed on a cruise ticket contract. By purchasing or accepting the ticket contract for Saga Carnival, you represent to and for the benefit of Saga Carnival and the cruise line that you are authorized by all Guests named in your reservation group, including each minor, if any, to accept and agree on behalf of each such Guest to be bound by all the Terms herein and of the ticket contract. Each Guest’s reservation for Saga Carnival, acceptance and/or use of the ticket contract, embarkation on the Cruise, and attendance at any Saga Carnival event, whether on or off the ship, constitute the acceptance of and agreement to this Contract, including each and all of the Terms herein and of the ticket contract.

Nature Of The Cruise

Saga Carnival is a special destination event for Bahamas Carnival that features multiple Artists and DJs performing at carnival-related events hosted on and off the ship. Nothing contained herein is intended to be, nor shall it be construed as a right or guarantee to specifically attend any particular concert on any particular date to be performed by any particular artist. Saga and Guest agree that each Guest is purchasing passage on board a specific vessel during a specific period of time during which time it is anticipated that musicians will perform concerts on or off the vessel. Included in such purchase price, but ancillary thereto is an entertainment package pursuant to which guests will participate in a carnival parade and carnival-related events along with performances by several artists at a time or times during the Cruise which times will be announced prior to sailing and/or during the Cruise. While every effort is made by Saga to avoid conflicting events and performances, Saga cannot guarantee that any Guest will be able to attend every performance on or off the ship.

Acceptance & Agreement to cruise line ticket contract

By making this reservation, or by acceptance and/or use of the ticket contract, the person named thereon as Guests, each passenger and guest on the same reservation, acknowledges he or she has read, and understands each and every term, condition, and provision of the ticket contract and agrees to be bound thereby. In addition, by making this reservation or by the acceptance and/or use of the ticket contract by the persons named as Guests, it shall be deemed to bear acceptance and agreement by each and every person to all the additional Terms and Conditions set forth herein.

Guest acknowledges and expressly agrees Saga Carnival (and its affiliates) are acting solely in their capacity as tour operators, brokers and independent contractors arranging this cruise and related events and that Saga Carnival has no right or ability to control or direct the operational or navigational activities of the vessel or crew in any manner whatsoever whether aboard the ship or ashore including without limitation persons furnishing services to the vessel or to the guests including shoreside excursions, personnel, or contractors, embarkation and disembarkation to and from the vessel, the condition of the vessel and its equipment.

All rights, defenses, disclaimers and limitations of liability set forth herein shall inure to the benefit of Saga, and all concessionaires, independent contractors or other providers of any services or facilities in connection with or incident to the Guest’s cruise, as well as any of their affiliated or related companies, parents, subsidiaries, successors, assigns or fictitiously named entities; and all suppliers, shipbuilders, component part manufacturers; and their owners, operators, managers, charterers, agents, pilots, officers, crew, employees and vessels. Neither Saga, nor any of its employees have any authority to change, modify, alter or suspend any of the provisions of the Contract between the Guest and the cruise line which shall govern the relationship between Guest and the cruise line exclusively.

Cruise Fare

Includes your accommodations on-board the ship, including government taxes and fees and on-board service gratuities, all meals in the main dining room(s) and buffet, other casual dining throughout the day, non-carbonated beverages (coffee, tea, juices, etc), 24-hour room service (surcharge may apply to some items), use of the ship’s pools, health and fitness centres, general admission to all Saga Carnival hosted events on and off the ship and a backline carnival costume.

Your cruise fare does not include fuel surcharges, transportation to/from the ship, shore excursions, sightseeing or meals ashore, meals in any specialty or à la carte restaurants, laundry, wine, beer, liquors, cocktails, soda, mineral water, medical expenses, spa, beauty salon, casino gaming, onboard shopping, or any other items of a personal nature.

All “Primary Guests” (see below) are obligated for the full cruise fare of the occupancy level of your stateroom selected during the reservation process, even if you do not provide additional guest information at that time.

All prices are per person, quoted in US Dollars, are subject to change, and are based on availability.

Saga Carnival is Non-Refundable and Non-Transferable once purchased. There are no refunds for cancellations, regardless of the reason. The payment of your deposit and/or any other payment and/or by attending its event/s confirms that you accept and agree to these Terms & Conditions including our Cancellation Policies herein.

Costume Policy

Unless otherwise noted, your cruise fare includes a backline carnival costume from Saga Carnival. Note that costumes remain the property of Saga Carnival until paid for in full and collected.

Carnival costumes are custom-made items therefore, after a registration has been made with the required deposit, there shall be:- 

  • NO exchange or switching of sections,
  • NO changing of measurements or sizes,
  • NO costume transfers,
  • NO returns/exchanges, and
  • NO refunds for costume upgrades or add-ons.

This shall also apply to any costume once it has been collected and has been signed for as having been received in good condition.

Any complaints/reports must be submitted no later than 7 days after the carnival parade, any complaints received later will be deemed as invalid. Photographic/Video evidence is needed where necessary.

Primary Guests

The guest who places a reservation for a cabin onboard Saga Carnival will be considered that cabin’s “Primary Guest” and is the “leader” of the reservation.

The Primary Guest is ultimately responsible for making sure that all deposits and reservation payments are kept current by all guests on the reservation who have been assigned financial responsibility. Financial default of any guests on the reservation becomes the responsibility of the Primary Guest to resolve or be subject to increased occupancy fees and/or cancellation.

Roommates/Cabinmates

Your decision to accept a roommate for the Cruise is at your own risk. Saga Carnival and its Released Parties are not responsible nor liable for any and all claims or cause of action arising out of or in connection with your selection of a roommate for the Cruise, including, without limitation, any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from such request or selection.

Financial Responsibility

During the reservation process, Primary Guests may choose to pay the entirety of their reservation or assign financial responsibility (split the required deposits and payments) to any of the other guests sharing the cabin.

Any guests with financial responsibility for a reservation must provide the appropriate deposits AND comply with payment deadlines based on the date that the reservation was booked.

If the Primary Guest is paying for the entire cabin, he or she is responsible for the required deposits, full cruise fare and fees for the number of guests selected for the cabin reservation, even if additional guest information is not provided.

If the Primary Guest makes initial reservation deposits on behalf of other guests in the cabin using multiple credit cards, the Primary Guest must have the credit card number, expiration date, card verification code (CVV number), cardholder name and billing address for each paying guest. Following initial deposit payments, each guest with financial responsibility will be able to make their own payments via their personal Saga Carnival Reservations Profiles.

Pricing & Payment Schedule

All advertised prices are in US Dollars and are per person, subject to change, and are based on availability.

Prices include all taxes and fees and gratuities for ship shipboard staff.

Saga reserves the right to increase published prices without notice. In the event of an increase, only new reservations will be affected. Any reservations made prior to the fare increase will be protected at the rate they booked and fully deposited at. 

ALL DEPOSITS AND PAYMENTS ARE NON-REFUNDABLE.

Saga Carnival accepts reservations and payments according to two schedules (detailed below). The date you make your reservation will ultimately determine your total deposit due at the time of booking and the subsequent payment dates.

Monthly Payment Plan

Deposits

  • $250 per person deposit is due at the time of booking for all Staterooms ($400 deposit due for Single occupancy bookings)
  • $500 per person deposit is due at the time of booking for Suites ($700 deposit due for Single occupancy bookings)

Following your initial deposit, the remaining balance will be split into equal monthly instalment payments, and automatically processed. 

All balances must be paid in full by the agreed Final Payment Date.

NOTE: If the total deposit amount required for your reservation (based on your stateroom’s occupancy level) has not been paid in full within 48-hours of booking, Saga Carnival reserves the right to discard that reservation in its entirety.

New reservations made within sixty (60) days of sailing

A minimum 50% deposit is required, and the full remaining balance must be paid no later than fourteen (14) days before sailing.

New reservations made within thirty (30) days of sailing

Must be paid in full at the time of the reservation.

Automatic Billing

All instalment payments will be automatically charged to the credit card you have on file in your Saga Carnival Reservations account.

Single Guests

All cabin deposits are based on a minimum of double occupancy. Single guests will be billed at the single occupancy supplemental rate.

Additional Payment Info

Most major credit cards including Visa, Mastercard, American Express and Discover are accepted.

Third-party credit card payments (from a person not attending the cruise) are accepted only when a Third Party Credit Card Authorization Form is signed by the cardholder. If you are paying with a Third Party Credit Card, please complete our credit card authorization form. Please return to us within 48 hours of booking. 

Late Payment Fees

Late Fees will be applied per guest for each cabin that does not remit payment by the required payment due dates. 

Should your payments be declined or returned by your bank you will have up to five (5) business days to resolve the issue. After which Saga Carnival will automatically charge delinquent accounts an Administrative Late Fee of $25. This fee will be added to your outstanding payment amount. Payments received will be applied first to cover the administrative fee, then the remaining amount of the payment will be applied to your reservation balance.

The 5-day grace period shall be given after which, a $25.00 late fee will be applied to your account.

If you miss two or more consecutive payments, your reservation will be subject to cancellation without a refund.

For all reservations where payment in full has not been received by the due date, Saga reserves the right to consider that reservation cancelled, and to charge the applicable cancellation penalties.

Name Changes, Transfers & Fees

Primary Guests are obligated for the full cruise fare and fees of the occupancy level of your stateroom selected during the reservation process, even if you do not provide additional guest information to us.

The Primary Guest is solely responsible for initiating or authorizing changes to the reservation, must agree in writing to any changes made to the reservation, and must submit all requested changes using our Name Change Request Form.

The Primary Guest is not allowed to change his or her name within the reservation and must remain on the reservation. If all original guests cancel, this is considered a full cancellation without a refund, and name changes will not be allowed.

NAME and CABIN NUMBER changes can be made up until 30 days prior to sailing (if allowed by the cruise line), and will be assessed the following administrative fees per change:

$25.00 for name and stateroom changes up to 90days prior to sailing

$50.00 for name and stateroom changes up to 60days prior to sailing

$150.00 for name and changes up to 30days prior to sailing (upon approval by the cruise line).

Unnamed Guests: You will have up to 60days prior to sailing to provide us with the names and contact information for any unnamed guests added to your reservation at the time of booking. Names provided after this date will incur a name change fee, based on the above schedule.

In all cases of name changes, the NEW guest must make full payment. Once that payment has been made, then the applicable amounts paid by the ORIGINAL guest will be refunded directly to the original guest, less the cost of the name change fee.

All Name Change requests must be submitted in writing via the Name Change Request Form. 

The date that such notice of change is received via these forms will determine the applicable fees per the above schedule. No exceptions will be made.

Please Note: Your cabin number is subject to change without notice at the discretion of the cruise line.

Guest Cancellation Policy

ALL RESERVATIONS DEPOSITS AND PAYMENTS ARE NON-REFUNDABLE

Due to the unique nature of our event, any and all cabin reservations, costume and costume upgrades, pre-party purchases, and the additional taxes/fees/gratuities are non-refundable for any amount or any reason, and cancellation forfeits all payments. There are NO exceptions to our cancellation policy. We strongly recommend the purchase of travel insurance.

All cancellation requests must be submitted in writing by using our Cancellation Request Form.

The date that such notice of cancellation is received via this form will determine the applicable fees per the above schedule. No exceptions will be made.

Chargebacks & Attorneys’ Fees

A credit card chargeback occurs after a cardholder initiates a merchant dispute with their issuing bank, the issuing bank will then charge back the transaction being disputed to Saga Carnival and the cardholder’s account is credited. Saga Carnival will make every effort to avoid chargebacks by providing documentation to the issuing bank that the customer did in fact attend and/or participate in a Saga Carnival event; in the event we are unsuccessful, all efforts will be made by Saga Carnival to recover any outstanding money including legal action.

Saga Carnival also reserves the right to charge, and you agree to pay, in addition to the amount not paid, rejected or refused, a fee of 5% of such amount, or the highest rate allowed under applicable law. You also agree to pay all collection costs, including attorney and court’s fees, incurred by Saga Carnival in collecting any amounts that you owe to Saga Carnival.

No-Shows

There will be no refunds given for those who do not board the ship on time, unused tickets, or after the Cruise has occurred. If a flight or other delay for any reason prevents you from joining the cruise by the boarding time on the departure date, you will be considered a no-show, and we cannot provide a full or partial refund or credit toward a future cruise. Please note that your decision not to travel due to State Department advisories or fear of travel will constitute a cancellation by you. No refund or credit will be given for any unused features or early departures for any reason.

Age Requirements

Guests must be 18 years of age or older on the date of departure in order to reserve a cabin for the Cruise. 

Passport & Legal Document Requirements

Saga Carnival strongly recommends that ALL of our guests travel with a passport, valid for at least six months beyond the completion of travel.

Having a valid passport will help to expedite the debarkation experience as delays may be expected upon return to the United States for those without one. Additionally, this will enable guests to fly from the U.S. to meet their ship at a foreign port should they miss their scheduled port of embarkation and allow guests who must disembark the ship before their cruise ends due to an emergency to fly back to the U.S. without significant delays and complications.

Names on Travel Documentation

The name on your cruise reservation/ticket MUST MATCH the name on your passport (or birth certificate and government-issued photo I.D., see below). 

Cancellation by Performing Artist

Saga Carnival has entered into an agreement with each performing artist to be present and to perform in accordance with terms specified therein. However, Saga Carnival shall not be liable or responsible for the failure of any Artist or DJ to appear or to perform under its agreement. Further, Saga shall not be liable or responsible for any loss, damage, cost, or expense of any kind to any guest or any other person or entity in the event that such performance is prevented or such loss, damage, cost, or expense is caused by or results directly or indirectly from any act of God, war, fire, collision, directions of underwriters, arrest, order or restraint by any government agency or official acting under colour of authority, acts of terrorism, labour disturbances or disputes, civil commotion, weather conditions and considerations of the safety of the vessel (for which the Master shall be the sole judge), breakdowns of or damage to the vessel’s hull or machinery, requisition of the vessel by a governmental authority, illness, death of a family member or other cause or circumstance beyond Saga Carnival’s reasonable control. In the event of any failure of contracted artists to perform, Saga Carnival, in its sole discretion, may engage a replacement artist or artists or may change, postpone or terminate all or any part of the Cruise or the entertainment program or change the program or itinerary. In such a case, Saga Carnival shall have no liability to any guest for any loss, damage, cost or expense whatsoever by reason of such change.

Cancellation By Saga Carnival and/or the Cruise Line

In the event of a strike, lockouts, riots or stoppage of labour from whatever causes, or for any other reason whatsoever beyond the control of Saga Carnival or the cruise line, Saga Carnival and/or the cruise line may, in its sole discretion cancel, advance, or postpone any scheduled sailing or call at any port and may (but is not obligated to) substitute another vessel, and neither the cruise line nor Saga Carnival shall be liable for any loss whatsoever to guests by reason of such cancellation, advancement, postponement, or substitution. Thereupon, Saga Carnival shall return to you, if the Cruise is completely cancelled, your cabin fare and related taxes and fees, or, if the Cruise is partially cancelled, a proportionate part thereof. Under such circumstances, Saga Carnival and the Released Parties shall have no further liability for damages or compensation of any kind. Please note that the availability of any refund for travel insurance and/or other travel products (airfare, hotel, car rental), even if purchased in conjunction with the Cruise, will be determined in accordance with the applicable cancellation policies for such other products or services.

Right To Change Itinerary

Saga Carnival and/or the cruise line reserve the right, at any time, to change the cruise itinerary whenever advisable or necessary. In this case, Saga Carnival and/or the cruise line will NOT be responsible for any loss or expenses caused by reason for such changes or abandonment. Refunds will NOT be made to guests who elect not to complete the cruise for any reason or cause whatsoever.

Safety While In Ports Of Call and Onboard

Travellers assume sole responsibility for their safety onboard and in any port of call. Saga Carnival encourages travellers to exercise discretion while on board as well as at any ports of call. You agree that Saga Carnival assumes no responsibility and shall not be held liable for any property loss, damage, injury, or delay to you or your property while onboard Saga Carnival cruise.

Shore Excursions & Cruise Amenities

You acknowledge that all shore excursions and tours, however conducted; airline flights and ground transportation; and any ship physician, nurse and onboard concessions (including, without limitation, gift shops, spa, beauty salon, fitness centre, golf and art programs, and video/snorkel concession) are operated by independent contractors. Saga Carnival neither supervises nor controls their actions, nor makes any representation, whether expressed or implied, as to their suitability. These services are provided only as a convenience for you, and you are free to use or not use them. You agree that each of the Released Parties assumes no responsibility, does not guarantee performance and in no event shall be liable for any negligent or intentional acts or omissions, loss, damage, injury or delay to you and/or your property in connection with these services. You use them at your own risk.

Inoculation & Health

All guests must ensure that they are medically and physically fit for travel and participate in Saga Carnival-hosted events. The Centers for Disease Control (CDC) and the World Health Organization (WHO) provide guidelines as to which vaccinations are required in each country. In many cases, inoculations are recommended but in some circumstances, they are required. We recommend that you check with your health care professional or a Travel Medicine Specialist certified by the WHO for guidance. Other informational resources can be accessed at the Center for Disease Control and Prevention’s Traveler’s Health website or toll-free at 1-877-FYI-TRIP, and the World Health Organization website.

Special Assistance & Needs

By booking the Cruise, you warrant that you, and those travelling with you, are physically fit to travel at the time of embarkation. You must notify Saga Carnival at the time of booking of any disability or other medical or physical condition that may require special assistance during the Cruise. Your failure to do so will release Saga Carnival from any liability for loss, damages or other compensation arising from or related in any way to such disability or condition. Saga Carnival and the cruise line reserve the right to require that any passenger who is not self-sufficient, travel with a companion who shall take responsibility for any assistance needed during the Cruise and in case of emergency.

Medical Care

You assume all risks associated with travel and transportation on the Cruise and participation in the carnival parade and carnival related events. While at sea or in port, the availability of medical care may be limited and/or delayed. You acknowledge that all or part of the Cruise may be in areas where medical care and/or evacuation may not be available. You agree to indemnify and reimburse Saga Carnival and/or the cruise line in the event that either party, in its sole discretion, advances to you the cost of emergency medical care, including medical evacuation and/or medical care provided ashore, as well as transportation and/or lodging in connection therewith. Saga Carnival shall have no responsibility to advance any such costs and strongly encourages you to purchase Travel Insurance to address any such contingencies.

Zero Tolerance Threats & Violence

Saga Carnival has a zero-tolerance policy regarding threats and violence. This includes all physical and or verbal abuse. Any and all threats, threatening behaviour, and acts of violence against Passengers, Saga Carnival or cruiseline Staff, and/or property will not be tolerated. Any violation of this policy can result in disembarkation from the vessel and the individuals being turned over to the local law enforcement officials for appropriate legal action. In such a case, Saga Carnival shall not be liable for refunds or any other compensation that may arise for such an occurrence.

Vending

Guests are strictly prohibited from promoting, distributing, or offering for sale any merchandise, goods, souvenirs or other products and materials during the Cruise or at any Saga Carnival-hosted event which promotes personal or 3rd party companies or services, and/or which include any company names, service information, or contact info, etc., without first obtaining written approval from Saga Carnival. All requests for permission must be submitted in writing before sixty (60) days prior to departure at hello@sagacarnival.com.

Please do not make t-shirts, hats, posters, jewellery, marketing materials and/or anything else to sell/promote during the cruise/event. Anyone found in violation of this policy will have his or her unauthorized merchandise/materials confiscated. This policy will be strictly enforced.

Photography & Videography

Video and/or audio recording, filming, and/or photographs may occur onboard the Cruise and/or at any Saga Carnival-hosted Events, which may be owned, licensed, assigned, and/or distributed worldwide by Saga Carnival, their affiliates, and assignees. You hereby consent to, permit, authorize and allow Saga Carnival and its affiliates and assignees the right to use your likeness in any manner whatsoever. You will not receive any compensation for such use and hereby waive any right to bring any claim and/or action in law or equity against permitting Saga Carnival and their affiliates and assignees for such use.

Photo and video crews will be shooting footage to be used for the promotion of future Saga Carnival events. When these teams are shooting in any particular location/venue at a Saga Carnival-hosted event, your presence in said location/venue acknowledges your permission for your likeness to be used in future, promotional videos or still pictures. If you do not wish to be photographed or filmed, please notify the photographers and/or video crew and be prepared for them to instruct you to exit the location/venue for a short time until such time as photographing and filming is complete.

You further agree to allow, without compensation, your likeness and/or name to appear, and to otherwise be used, in material, regardless of media form, promoting the Bahamas Carnival or Saga Carnival, and/or its, events and activities, including those of its representatives, assigns, and licensees.

Photo/Video Policy for Guests

Guests are permitted to take personal photos using fixed-lens cameras everywhere onboard the cruise. However, please refrain from flash photography in all indoor concert venues. The use of detachable lens cameras (DSLR, other professional cameras, etc.), tablets (iPads, etc.), camera and video sticks, and any video or audio recording devices, will not be permitted during shows and will be strictly enforced by event security. Remote-controlled photo/video drones are strictly prohibited.

We request all guests to be respectful of our performers’ personal space and time between shows and refrain from photo/autograph requests. They, like you, have been invited onboard to relax and enjoy themselves with their friends and family, during their vacation time on the cruise. We will have several photo meet and greets with the artists scheduled for the opportunity to have your photo taken with them. We, and they, appreciate your cooperation!

Refusal Of Passage

Saga Carnival acts only as a sales and marketing agent for the purpose of booking travel arrangements on the cruise line and for the participation in Bahamas Carnival. Saga Carnival expressly disclaims any responsibility for personal injury, property damage, loss, delay, inconvenience, or other matters due to negligence, wrongful acts, errors or omissions on the part of any third party, or any supplier of services of goods or of agents selected by you or your travel agent. Participation on the Cruise may be denied to any person who, in Saga Carnival’s or the cruise line’s sole discretion: (1) is or becomes in such a condition as to be unfit to travel; (2) is dangerous or obnoxious to others; or (3) is inadmissible under the laws of any country of debarkation. In addition, Saga and the cruise line reserve the right to refuse passage, disembark or confine to a stateroom any person whose physical or mental condition or behaviour they consider, in their sole discretion, to constitute a risk to the person’s own well-being or that of any other person. Saga Carnival shall have no liability to any such person or any third party arising out of any such decision. Any costs resulting from Saga Carnival’s and/or the cruise line’s decision, including, without limitation, costs of lodging and transportation, shall be the responsibility solely of the person.

Passenger Duty

A Passenger, or if a minor, his or her parent or guardian, shall be liable to, and shall reimburse the Released Parties for, any damage to the Released Parties’ property, including the vessel or any property of the cruise line or other caused directly or indirectly, in whole or in part, by any wilful or negligent act or omission on the part of the Passenger; and Passenger, or if a minor, his or her parent or guardian, shall further indemnify the Released Parties and each and all of their agents and servants against all liability which the Released Parties may incur towards any person or company or government for any personal injury, death or damage to property caused directly or indirectly, in whole or in part, by any wilful or negligent act or omission on the part of Passenger.

Guest Conduct Policy

Saga Carnival  and the cruise line will not tolerate any behaviour by Guest which negatively affects the comfort, enjoyment, health, safety or well being of other Saga Carnival passengers, its performers and staff, other onboard guests or the ship’s crew. This shall also include harassment or bullying on public forums, social media networks or by any other means that may cause harm or discomfort to Saga Carnival passengers, its performers and staff, other onboard guests. Saga Carnival and the cruise line do not permit nudity in any of the vessel’s public venues. Audio equipment used for personal entertainment may be brought on board but cannot be played at levels disruptive to other guests. Violation of this policy will result in the confiscation of the equipment. Theft of any kind will not be tolerated and will result in discontinuance of passage and/or being prohibited from sailing onboard Saga Carnival or the cruise line cruises in the future.

Guest agrees to comply with this policy, and further acknowledges that Saga Carnival and/or the cruise line reserve the right to refuse or discontinue passage to any guest who, in the judgment of Saga Carnival’s management and/or the cruise line vessel management, violates the cruise line’s ticket contract or who is deemed a danger to himself, herself or others, or is conducting themselves in a manner that otherwise adversely affects the overall cruise experience of others. In all cases, Saga Carnival and the cruise line shall not be liable for any damages, refund or other compensation, including travel costs.

Illegal Substances

Saga Carnival and the cruise line strictly prohibit the possession, distribution or use of non-prescription drugs of ANY KIND onboard the vessel. All passengers agree to comply with this policy, and further acknowledge that any passengers who are found with such illegal substances will not be allowed to board or will be disembarked at the next port of call.

Guest acknowledges that it is Saga Carnival and the cruise line’s policy to report incidents of illegal activity or behaviour to the appropriate law enforcement authorities for appropriate legal action. In such cases, Saga and the cruise line shall not be liable for any damages, refund or other compensation, including travel costs.

Alcoholic Beverages

Alcoholic beverages will not be sold or served to anyone under the age of 21 (18 in the Bahamas). We reserve the right to refuse the sale of alcoholic beverages to anyone. Alcoholic beverages purchased in the vessel’s gift shops or at a port of call will be retained by the cruise line until the end of the voyage.

For safety reasons, guests are prohibited from bringing alcoholic beverages on board. Saga Carnival and the cruise line encourage the responsible use of alcohol and accordingly reserves the right to permanently or temporarily revoke the drinking privileges of any guest who violates the cruise line’s Guest Conduct Policy or who is deemed a danger to himself, herself or others by Saga management and/or the cruise line vessel management. Continued abuse of alcohol while sailing and/or violation of Saga and the cruise line’s alcohol policy may result in immediate disembarkation. In such cases, Saga and the cruise line shall not be liable for damages, refund or other compensation, including travel costs.

Smoking Policy

Smoking is a fire and safety hazard on a ship. Consequently, it is strictly limited to specific exterior deck areas and designated casino/nightclub spaces that can be monitored. All guests are expected to adhere to the following safety guidelines:

  • All staterooms and suite accommodations, including outside balconies, are NON-SMOKING. This policy applies to all forms of smoking, including but not limited to cigarettes, cigars, pipes, vapourizers, electronic cigarettes and marijuana.
  • The cruise line recognizes that some state and local governments in the U.S., and in the destinations we visit, might allow marijuana use. However, the cruise line follows U.S. federal law, which strictly prohibits possession and use of recreational/medicinal marijuana and other illegal controlled substances.
  • Any violation of this policy will result in a $500 charge, per violation, posted to the guest’s account and may also result in the disembarkation of all guests in the stateroom.
  • Guests who are disembarked for violating our policy will be responsible for all financial charges and expenses to return home, and no refund of their unused cruise fare will be provided. Additionally, they may be prohibited from sailing with the cruise line in the future.

All public areas throughout the vessel are smoke-free. SMOKING IS NOT ALLOWED IN CABINS OR ON BALCONIES. Guests who smoke in their staterooms or on their balconies will be assessed a cleaning and refreshing fee on their cruise line account. Information on this policy and fee is included in the cruise line’s Contract. Guests agree to strictly comply with the cruise line’s non-smoking policy.

Cigarette, electronic cigarettes and personal vaporizer smoking is permitted in designated areas only.

Guests agree to comply with this policy and further acknowledge that any violation of this policy could result in disembarkation from the vessel, as well as additional fines levied by Saga Carnival and/or the cruise line. In such cases, Saga Carnival and the cruise line shall not be liable for damages, refunds or other compensation, including travel costs.

Typographical Errors

In the event an item is listed at an incorrect price or with incorrect information due to typographical error or error in pricing, Saga Carnival shall have the right to refuse or cancel any orders placed for the item listed at the incorrect price. Saga Carnival shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, Saga Carnival shall immediately issue a credit to your credit card account in the amount of the charge.

Limitation Of Liability

By booking the Cruise, you (the guest) agree to release and hold harmless the Released Parties, from and against any claim or cause of action arising out of or in connection with your travel on and participation in the Cruise and Carnival related events, including, but not limited to: (1) injury, death or delay of passengers, or loss, damage or delay of or to passengers’ baggage or other property, which may be caused, directly or indirectly, in whole or in part, from participation in the Cruise and Carnival related events, including, without limitation, passenger’s use of or participation in any shore excursion, on board concession or athletic or recreational activity; (2) your request for or selection of a roommate for the Cruise; (3) emotional distress, mental suffering or anguish or psychological injury of any kind under any circumstances (except when such damages were caused by the Released Parties’ negligence and resulted from the same passenger’s sustaining actual physical injury, or having been at risk of actual physical injury, or when such damages are held to have been intentionally inflicted by the Released Parties); (4) any change in schedule, scheduled Cruise and Carnival related events and/or music appearances; or (5) the cruise line exercise of its contractual rights (see below). You further agree that the Released Parties shall not be held vicariously liable for the intentional or negligent acts of any persons not employed by any of the Released Parties, nor for any intentional or negligent acts of any of the Released Parties’ employees committed while off duty or outside the course and scope of their employment.

In the event that a court of competent jurisdiction holds any of the foregoing to be unenforceable, then the Released Parties’ liability shall be limited to the maximum extent permitted by law. In addition, in such case:

  • Claims for Personal Injury, Illness or Death: – The Released Parties shall not be liable for any claims whatsoever for personal injury, illness or death of a passenger unless full particulars in writing are given to Saga Carnival within 21 days after the date of the injury, event, illness or death giving rise to the claim. Suit to recover on any such claim shall not be maintainable unless filed within one (1) year after the date of the injury, event, illness or death, and unless served on Saga Carnival within 120 days after filing. You (the passenger) expressly waive all other potentially applicable state or federal limitations periods.
  • Claims other than Personal Injury, Illness or Death: – The Released Parties shall not be liable for any claims whatsoever, other than for personal injury, illness or death of a passenger, unless full particulars in writing are given to Saga Carnival within 30 days after the passenger is landed from the Cruise, or if the Cruise is abandoned, within 30 days thereafter. Suit to recover on any claim whatsoever other than for personal injury, illness or death shall not be maintainable unless filed within six months after the date the passenger is landed from the Cruise or the Cruise is abandoned, and unless served upon Saga Carnival within 120 days after filing. You (the passenger) expressly waive all other potentially applicable state or federal limitations periods.

THE EXCLUSIONS OR LIMITATIONS OF LIABILITY OF THE RELEASED PARTIES SET FORTH IN THE PROVISIONS OF THIS CONTRACT SHALL ALSO APPLY TO AND BE FOR THE BENEFIT OF AGENTS, INDEPENDENT CONTRACTORS, CONCESSIONAIRES AND SUPPLIERS OF THE RELEASED PARTIES, TOGETHER WITH THE EMPLOYEES AND SERVANTS OF EACH OF THE FOREGOING. WITHOUT LIMITING THE PRECEDING SENTENCE, IN NO EVENT WILL THE RELEASED PARTIES OR the cruise line BE LIABLE TO PASSENGER FOR ANY CONSEQUENTIAL, INCIDENTAL, EXEMPLARY OR PUNITIVE DAMAGES.

Decisions of the Cruise Line

You will receive the cruise line ticket contract (“ticket contract”) with your Cruise ticket. The ticket contract constitutes your agreement with the cruise line. The ticket contract provides that the cruise line may exercise its rights in a variety of matters, including, without limitation: Its right to alter the ship’s course, ports of call, itinerary, activity and shore excursions, for any reason, to ensure the comfort and safety of the passengers and crew;

Its decision to comply with any order, recommendation or direction given by any government or other person or Saga Carnival; and its decision to deny boarding to, confine to a stateroom or disembark any Cruise passenger. The Released Parties (as defined above) shall not be liable to you or any third party for any claim or cause of action arising, directly or indirectly, in whole or in part, out of the cruise line exercise of any of its rights as provided in the cruise line Terms. Without limiting the foregoing, the Released Parties shall not be liable to any Cruise passenger for a full or partial refund of any Cruise fare, or for any lodging or transportation expenses, as a result of the cruise line exercising its contractual rights.

Disputes

Except where prohibited by law, you (the passenger) expressly agree that: (1) any and all disputes, claims and causes of action arising out of or connected with the Cruise and the Carnival related events shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Nassau, New Providence, The Bahamas to the exclusion of the courts of any other state, territory or country; (2) you waive any venue or other objection that you may have to any such action or proceeding being brought in any court located in Nassau, New Providence, The Bahamas; (3) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with the Cruise, but in no event attorneys’ fees; and (4) you waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct or indirect damages. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions shall be governed by and construed in accordance with the laws of the Commonwealth of the Bahamas, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of the Bahamas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of the Bahamas. You agree to present any claims against us within 30 days after the Cruise ends and to file within one year of the incident, and you acknowledge that this expressly limits the applicable statute of limitations to one year. NEITHER PARTY MAY INITIATE OR BE PART OF A CLASS ACTION LAWSUIT OR LEGAL PROCEEDING AGAINST THE OTHER.

Miscellaneous

The cruise line reserves the right to substitute the Cruise vessel. Any consequences arising out of the cruise line exercise of this right shall be governed by the agreement between the cruise line and Saga Carnival, and not by the cruise line’s agreement with you, the guest. Furthermore, in the event of any conflict between the cruise line Terms and these Terms & Conditions, these Terms & Conditions will prevail. In addition, the cruise line and/or Saga Carnival may reassign cabins as determined necessary or desirable by the Vessel’s Safety Department or Saga Carnival, in their sole discretion.

All trademarks are the exclusive property of their respective owners.

The information contained on this page and in other pages and material relating to the Cruise, and the Carnival related events including any information regarding Artist and DJs participation and programmed events, is subject to change at any time and without notice. The details shown are for informational purposes only. The Released Parties are not responsible for any errors, changes and/or omissions resulting in pricing, inventory or content discrepancies.

Guest acknowledges and confirms that any travel agent utilised by the guest in connection with the issuance of his or her ticket is, for all purposes, the guest’s agent and the Released Parties shall not be liable for any representation made by said travel agent. Guests shall at all times remain liable to Saga Carnival for the advertised price of passage.

In addition to the restrictions and exemptions from liability provided in these Terms and Conditions, the Released Parties shall have the full benefit of any applicable laws providing for limitation and exoneration from liability, and nothing in contained herein is intended to operate to limit or deprive the Released Parties of any such statutory limitation of or exoneration from liability. Without limiting the foregoing, the Released Parties claim benefit of all restrictions, exemptions and limitations of the “Convention Relating to the Carriage of Passengers and Their Luggage by Sea” of 1974 as well as the Protocol to the “Convention Relating to the Carriage of Passengers and Their Luggage by Sea” of 1976 (“Athens Convention”), which limits the liability of the Released Parties for the death of or personal injury to a guest to no more than the applicable amount of Special Drawing Rights as defined therein, and all other limits on damage or loss to personal property.

These Terms and Conditions and the terms accepted during the cruise reservation process contain the entire agreement between Saga Carnival and the Passenger and supersede any other agreements, written or oral, relating to the subject matter herein. Any waiver of any provision must be made in writing and signed by an authorised representative of Saga Carnival.

Agreement for Assumption of Risk, Indemnification, and Release, for Participants

In consideration of Saga Carnival’s consent to allow me to participate in any or all recreational or other activities related to Bahamas Carnival, (including without limitation, events hosted in part or in full by Saga Carnival), I hereby knowingly, freely and voluntarily agree to waive, release and discharge any and all claims for damages for death, personal injury, or property damage that may have, or that may subsequently accrue as a result of my participation in recreational or other activities offered, afforded, or sponsored by Saga Carnival.

Assumption of Risk

I understand that Bahamas Carnival, by its very nature, includes certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary and may range from minor injuries such as scratches, bruises, sprains, and the like, to major injuries such as loss of hearing, eye injuries, loss of vision, loss of limb, joint or back injury, heart attack, and concussions, to catastrophic injuries including death. I understand and appreciate that these and other risks are inherent in the above-listed events and activities. I hereby assert that my participation is voluntary and that I knowingly assume all such risks. I further understand that I am ultimately responsible for my own safety.

You, on your own behalf and on behalf of your heirs and assigns, do hereby now and forever fully and finally release, remise, acquit and discharge Saga Carnival and their respective affiliates, officers, directors, employees and agents (collectively) of and from any and all rights, claims, debts, damages, demands, actions, liabilities, responsibilities, causes of action, covenants, suits, and judgments, of any kind or nature whatsoever, whether known or unknown, developed or undeveloped, anticipated or unanticipated, discoverable or undiscoverable, which you have or might have or might claim to have against Saga Carnival arising out of or in any way related to or associated in any way with regard to your participation in Bahamas Carnival and/or any event host by Saga Carnival, or any injury, damage or loss of any nature related to or arising out of or in connection therewith.

Hold Harmless and Indemnification

I agree, for myself, my heirs, personal representatives or assigns, to defend, hold harmless, and indemnify, Saga Carnival, its officers, directors, employees, agents, volunteers, and affiliates, from and against any and all claims, demands, actions, suits, procedures, causes of action, damages, costs (including reasonable attorney’s fees) and expenses that may result from or are in any way related to my participation in Bahamas Carnival. This indemnity includes claims based on the negligence (whether sole, active, passive, or gross) of Saga Carnival, its officers, employees, agents, affiliates, and volunteers, but expressly does not include claims based on their intentional misconduct.

Release and Waiver

I hereby release, waive, and covenant, not to sue Saga Carnival, its officers, directors, employees, agents, volunteers, and affiliates, from and for any and all claims and/or liability resulting from any personal injury, accident or illness (including death), and/or property damage or loss, however, caused by, arising from, or in any way related to, my participation in Bahamas Carnival. This release includes claims based on the negligence (whether sole, active, passive, or gross) of Saga Carnival, its officers, employees, agents, affiliates, and volunteers. I understand that by agreeing to this clause I am releasing claims and giving up substantial rights, including my right to sue.

Conduct

I agree to follow all instructions, procedures, measures and directions given to me by Saga Carnival or any of its staff or representatives and understand that my failure to do so may result in property damage or injury or death to me or to a third party. I understand that my invitation to participate in recreational or other activities may be revoked at any time and for any reason by Saga Carnival or any of its agents, managers, employees, or representatives.

Severability

I understand that the foregoing waiver and assumption of risks agreement are intended to be as broad and inclusive as is permitted by the Commonwealth of the Bahamas and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect and be binding on me, my heirs, and my personal representatives.

I UNDERSTAND THAT THIS WAIVER, RELEASE, AND INDEMNITY IS INTENDED TO WAIVE, RELEASE, DISCHARGE, AND INDEMNIFY IN ADVANCE SAGA CARNIVAL AND ITS AFFILIATES, SUBSIDIARIES, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, INSURERS, AGENTS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS, FOR, FROM AND AGAINST ANY AND ALL LIABILITY TO ME ARISING FROM MY PARTICIPATION IN ANY AND ALL RECREATIONAL OR OTHER ACTIVITIES DURING OR ASSOCIATED WITH BAHAMAS CARNIVAL, INCLUDING ANY DEMAND, RIGHT OR CAUSE OF ACTION OF ANY KIND OR NATURE WHATSOEVER, WHETHER BASED ON TORT (INCLUDING NEGLIGENCE ON THE PART OF SAGA CARNIVAL), CONTRACT, WARRANTY, OR ANY OTHER THEORY OF RECOVERY, AT LAW OR INEQUITY, VESTED OR CONTINGENT, THAT I OR MY SPOUSE, FAMILY, PARENTS, CHILDREN, ESTATE, HEIRS, AGENTS, INSURERS, SUCCESSORS OR ASSIGNS MAY AT ANY TIME HAVE AS A RESULT OF MY PARTICIPATION IN RECREATIONAL OR OTHER ACTIVITIES DURING OR ASSOCIATED WITH BAHAMAS CARNIVAL. THIS ALSO INCLUDES, WITHOUT LIMITATION, ANY LIABILITY (INCLUDING CONSEQUENTIAL, INDIRECT, SPECIAL, OR INCIDENTAL DAMAGES) ARISING FROM INJURY OR DAMAGE THAT I SUFFER OR CAUSE DURING MY PARTICIPATION IN RECREATIONAL OR OTHER ACTIVITIES DURING OR ASSOCIATED WITH BAHAMAS CARNIVAL, WHETHER SUCH INJURY OR DAMAGE IS FORESEEN OR UNFORESEEN OR WHETHER RESULTING FROM NEGLIGENCE OR OTHERWISE.
